1. Acceptance of Terms
By registering an account, installing the Progressive Web Application (PWA), or using any blood matching services provided at **pbdaindia.org** (collectively, the "Platform"), you agree to comply with and be legally bound by these Terms of Service.
These Terms constitute a binding legal agreement between you and the **Progressive Blood Donors Association (PBDA)**. If you do not agree to these terms, you must immediately cease all access and delete your account.
2. Medical Disclaimer & Platform Intermediary
CRITICAL MEDICAL DISCLOSURE
PBDA is strictly a **volunteer-led communication intermediary platform**. We are **NOT** a medical facility, blood bank, healthcare provider, clinical storage, or diagnostic center. We do not test, match, store, or process physical blood.
Our platform acts solely as a real-time geographical directory tool connecting voluntary donors with blood seekers.
Transfusion Safety Disclaimer: PBDA cannot verify the medical health, donor eligibility, or safety of any user's blood. The donor and recipient must strictly follow standard hospital screening and clinical cross-matching procedures before any transfusion is administered. PBDA is not liable for medical reactions, transmission of diseases, or issues arising during or after a blood donation.
3. Voluntary & Non-Commercial Nature
All blood donations facilitated by the Platform are strictly **voluntary and free of charge**.
Indian Law Prohibition: Under the *Drugs and Cosmetics Act, 1940*, buying or selling blood, or offering financial rewards/incentives for blood in India is a serious criminal offense punishable by imprisonment.
Any user found demanding compensation, soliciting financial rewards, or attempting to buy/sell blood on this platform will have their account immediately terminated, their profile blacklisted, and their details reported to police authorities.
4. User Eligibility & Account Registration
To register and maintain an active account, you must adhere to the following requirements:
- Age Limit: You must be at least 18 years of age (the legal age for blood donation in India). Registering on behalf of a minor is prohibited.
- Information Accuracy: You agree to provide true, current, and complete details, including verified contact numbers, address details, and correct blood group information.
- Single Account: You may register only one profile. Creating multiple accounts or fake identities is a violation of these terms.
5. Guidelines for Voluntary Donors
As a voluntary donor on PBDA, you agree to the following guidelines:
- Honest Disclosure: You must answer the health check questionnaire honestly to ensure your safety and that of the recipient.
- Temporary Deferrals: You agree to update your availability if you are deferred temporarily (due to recent tattoos, medication, illness, or travel).
- No Commitments: Registering as a donor does not create a contract or absolute obligation to donate. You retain full freedom to accept or decline any match request.
6. Guidelines for Requesters
If you are requesting blood for a patient or family member, you agree to:
- Genuine Needs: Only post authentic requests matching actual patient needs at recognized hospital facilities. Posting commercial or resale requests is illegal.
- Respect Privacy: Never share a donor's personal information or phone number publicly outside of the platform. Stalking or spamming donors is strictly prohibited.
- Close Requests: Mark your active requests as fulfilled as soon as you find compatible blood, so our donors can focus on other critical emergencies.
7. Prohibited Conduct
To protect our community, the following behaviors are strictly prohibited on the Platform:
- Submitting forged or altered Aadhaar cards, medical certificates, or test logs.
- Any form of threat, harassment, or verbal abuse targeted at donors, recipients, or PBDA admin staff.
- Scraping the directory or database of donors for marketing, commercial lists, or external databases.
- Using automated scripts, bots, or browser extension tools to manipulate matching requests.
8. Moderation & Termination of Access
PBDA administrators retain absolute discretion to review profile logs, verification documents, and active requests.
We reserve the right to suspend or permanently terminate your access to the Platform immediately, without prior notice, if you breach any of these Terms, provide fraudulent information, or engage in behavior that compromises the safety of our voluntary donation network.
9. Limitation of Liability
The Platform is provided on an **"as-is" and "as-available"** basis without warranties of any kind, whether express or implied.
PBDA does not warrant that the Platform will operate uninterrupted, that a donor will always respond to an emergency, or that matching calculations will be 100% error-free.
In no event shall PBDA, its coordinators, founders, or developers be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use the Platform, or transfusion outcomes.
10. Governing Law & Jurisdiction
These Terms of Service shall be governed by and construed in accordance with the laws of the Republic of India.
Any dispute, controversy, or claim arising out of or relating to these terms or use of the Platform shall be subject to the exclusive jurisdiction of the competent courts in Nadia or the High Court at Calcutta, West Bengal, India.
